Coking Contractors, LLC is currently negotiating with FDS to be the general contractor performing the installation of the coke plant and co-generation facility. CAITCoal, Inc., is the coal sourcing consultant to the FDS Project. The company currently serves as a coal sourcing consultant to the European, South American and North American steel industry. Mr. Mark Brugnoli, Present of CAITCoal, Inc., has 25 years experience in international coal and coke markets serving the global steel industry.
Environmental
Labyrinth Management Group (LMG) is the primary environmental consultant for air permitting and strategic environmental aspects of the project. LMG staff have more than 20 years of experience providing environmental regulatory support services to industrial companies. LMG prepared the Ohio EPA PSD air permit application for the FDS Coke Plant and has acted as the project's air regulatory expert during the permitting process with Ohio EPA and US EPA Region V. Regulatory and Local Permitting
Regulatory and local permitting consultants for the FDS Project include Messrs. Thomas Kovacik and William Garber from Toledo, Ohio.
Mr. Kovacik, is the former Director of Public Utilities for the City of Toledo and the Director of the Toledo Department of Environmental Services ("TDES"). TDES is the delegated representative for Ohio EPA to implement Ohio's air, water and noise pollution programs applicable to the Project site and Coke Plant operation.
Mr. Garber, PE, BCEE, is the former Administrator of the City of Toledo Utilities Department. Mr. Garber is a Civil Engineer with emphasis in air pollution and industrial hygiene. He is an Ohio Licensed professional engineer and holds accreditation from the American Society of Environmental Engineers. Mr. Garber is also a Board Certified Environmental Engineer in the area of Air Pollution. Mr. Garber advises the Project on regulatory matters.
FDS Legal
Legal advisors for the FDS Project include Bell Boyd and Lloyd, LLP and Anspach, Meeks and Ellenberger, LLP.
Francis X. Lyons, Esq. is a partner at the law firm of Bell Boyd and Lloyd, LLP. Mr. Lyons served as the Regional Administrator of the US EPA Region V, serving Illinois, Michigan, Ohio and Wisconsin. For the FDS project, Mr. Lyons advises in matters of business law and environmental regulatory matters.
Scott Janson, Esq. is partner with the law firm of Anspach, Meeks and Ellenberger, LLP. Mr Janson is the project's Ohio Counsel, providing advice on commercial, corporate governance and tax legal matters.
Construction Bonding
In September 2006, the Ohio Air Quality Development Authority (OAQDA) passed Resolution No. 06-53 approving the authorization and issuance of one or more series of bonds in an amount up to $800 million to finance construction of the FDS Project. OAQDA's is a non-regulatory governmental agency with the primary mission to provide for the conservation of air as a natural resource of the Ohio by helping finance air quality facilities for small and large businesses, utilities, government, and universities.
Coke Market Placement
