The FDS Project Participants include world class companies with experts in the fields of project development, coke technology, industrial plant construction, project finance, and environmental compliance.

Executive Advisor

Mr. Ghais Makhlouf is advising FDS Coke Plant as the Executive Director for Raw Materials, Coal and Coke. Mr. Makhlouf has extensive experience in raw materials acquisition and production. In addition, Mr. Makhlouf owns a bi-product processing facility for use in the petroleum industry.

Financial Advisor

Earle Holsapple is a Financial Advisor to FDS Coke Plant. Mr. Holsapple has experience as a Chief Executive Officer for a large domestic corporation. In addition, Mr. Holsapple has experience as a company project developer for a unique techinology that is now patented in several countries.

Technical Advisor

Mr. Robert Chamoun, Dpl.Ing is a technical advisor to FDS. Mr. Chamoun has 50 years experience in international technical mechanical and engineering design. Mr. Chamoun holds seven mechanical engineering patents. Mr. Chamoun currently owns a company servicing the after component parts market in the United States and Lebanon.

Coal Sourcing

CAITCoal, Inc., is the coal sourcing consultant to the FDS Project. The company currently serves as a coal sourcing consultant to the European, South American and North American steel industry. Mr. Mark Brugnoli, Present of CAITCoal, Inc., has 25 years experience in international coal and coke markets serving the global steel industry.

Environmental / Energy Permitting / Compliance

Labyrinth Management Group (LMG) is the primary consultant for air permitting, strategic environmental and energy permitting aspects of the FDS project. Mr. Lance Traves, President of LMG, has more than 25 years of experience providing environmental regulatory support services to industrial companies. LMG prepared the Ohio EPA PSD air permit application for the FDS Coke Plant and has acted as the project's air regulatory expert during the permitting process with Ohio EPA and US EPA Region V. LMG also prepared the FDS Co-Generation facility's Ohio Power Siting Board application and is project manager for the MISO/PJM electrical interconnection process. Local Regulatory and Permitting

Local regulatory and permitting consultants for the FDS Project include Messrs. Thomas Kovacik and William Garber from Toledo, Ohio.

Mr. Kovacik, is the former Director of Public Utilities for the City of Toledo and the Director of the Toledo Department of Environmental Services ("TDES"). TDES is the delegated representative for Ohio EPA to implement Ohio's air, water and noise pollution programs applicable to the Project site and Coke Plant operation.

Mr. Garber, PE, BCEE, is the former Administrator of the City of Toledo Utilities Department. Mr. Garber is a Civil Engineer with emphasis in air pollution and industrial hygiene. He is an Ohio Licensed professional engineer and holds accreditation from the American Society of Environmental Engineers. Mr. Garber is also a Board Certified Environmental Engineer in the area of Air Pollution. Mr. Garber advises the Project on regulatory matters.

Legal Advisors

Legal advisors for the FDS Project include K.L. Gates, LLP, Tucker Ellis and West, LLP, and Anspach, Meeks and Ellenberger, LLP.

John "Jack" McCarthy, a partner with the international law firm of K.L. Gates, LLP, is overall Project Counsel. Mr. McCarthy is located in the K.L Gates Chicago, Illinois office.

Scott Janson, Esq. is a partner with the law firm of Anspach, Meeks and Ellenberger, LLP. Mr Janson is the project's Ohio Counsel, providing advice on commercial, corporate governance and tax legal matters.

Martin Lewis is a partner at the law firm of Tucker Ellis and West, LLP. Mr Lewis is lead environmental counsel in Ohio for the FDS Project.

Construction Bonding

In October 2010, the Ohio Air Quality Development Authority (OAQDA) passed Resolution No. 10-43 approving the authorization and issuance of one or more series of bonds in an amount up to $600 million to finance construction of the FDS Project. OAQDA's is a non-regulatory governmental agency with the primary mission to provide for the conservation of air as a natural resource of the Ohio by helping finance air quality facilities for small and large businesses, utilities, government, and universities.
